I may just read the guide to bullshitting it. I don't see how that much time is justified for an MEE only topic.

did you talk about estoppel for the husband trying to eliminate child support? The sample answer doesn't talk about it, it just says:

" Traditionally, courts have been loath to modify an established parent-child relationship, citing the child’s best interest as reason to deny admission of evidence of non-paternity or to deny a motion to disestablish paternity. "

And then addresses that some courts have given greater emphasis to the interests of non-biological father husbands. Does estoppel not apply for some reason?

Yeah, I mean, I mentioned everything else they said. I did the estoppel analysis, but then also threw in "best interest of the child" as like a safety net. Not sure how correct that was.

Fellow CA bar takers, what did you think of the graded con law essay (guy denied spot on cheerleading squad)? Was getting 65s and even a 75 on the other graded ones but got a 50 on that. Halfway through writing it, I realized I was focusing on all the wrong issues and deleted everything and started over with about 15 mins left. Although, after reading the sample I would have been better off leaving what I wrote.

Anyway, in the post essay lecture the guy said it was "atypical" and there hasn't been one like it since 2002. Really hope another one like that doesn't appear. Not feeling great about con law.

I wouldn't worry too much about it. It was OUT THERE. I talked about substantive due process (liberty interest) and equal protection (gender), but my analysis was COMPLETELY DIFFERENT from the model answer. I argued that his right to cheerlead was freedom of expression (liberty interest), and thus, subject to due process. Still managed to get a decent score. Don't forget that the exam is curved, so if you're thrown by a question, everyone probably is. Just make something up and sound lawyerly. Also, I feel like it's best to trust your gut when it comes to weird Q's like that.

For sure. Yeah the majority of the way through writing it I was writing basically the same thing you did. However, at one point I was like "wait... they don't care about the schools cheerleading decision, they want to know about this court administrator or whatever he was." Thats when I deleted everything and tried to start again which was a bad idea.

Did Mixed PQ Set 8 this morning, and missed the first four in a row, which kinda set the mood. Got a 62.

Took 30 minutes off, drove into town to grab an espresso to just get out of the damn house and clear my mind. Just finished Mixed PQ Set 10 at the coffee shop. Got a 76 (my highest score ever)

Fuck this stupid test. I don't think I have ever done anything in my life that has filled me with more ups and downs than prepping for the bar. It somehow combines the feeling of complete despair and exuberant elation within the same day

Why is Agency its own subject? Half of this was covered in Contracts/Torts and the other half is common sense.

I assume in the off-chance you get tested on (1) whether independent contractor is an employee for purposes of respondeat superior or (2) to test apparent authority/estoppel theories under contract law

Those are the two main issues that I see tested on the three agency essays I've done that are not touched on in the Torts or Contracts outline

Today, I got a 91% in the last Torts PQ set, and a 74% in Mixed PQ 5. Feels good, like stuff is finally coming together.

Thats awesome man. I probably missed it, but what is the final % correct Themis wants us to be consistently scoring? Is it different based on jurisdiction? Im hitting a little over 65 in most subjects but feel like consistently scoring 70+ won't happen for me.

Thanks! The latter single-subject sets top off at 65% goals, while it looks like the early Mixed sets start out at 60% but go up to 65%.

Adding some MD distinctions into my critical pass flashcards and was reminded of this fun fact:

In Paternity cases, MD may exercise PJ over a non resident father, if mother resides in MD, D properly served in MD, and...conception allegedly occurred in MD. That must be a fun one to argue.

I'm studying from 7am - 11pm with a 3 hour break in the middle of the afternoon because I need a nap. I spend the morning doing at least 50 MBE questions and meticulously go over each answer, even the right ones. I take 20 minutes after that to eat, then write a practice essay. I peter around on the internet or nap and eat from 2pm-5pm. I watch lectures from 6pm - 11pm. I'll be finished with the lectures tomorrow. I expect to change up my schedule after that. To what? IDK yet.

If you were above median at a T14 during 1L, you do not need more than 6 hours a day.

At least 6. I want to do at least 12. I did 11 today. But from here on out, the goal is 12 or more.
