What a coincidence! I just navigated to Sacuzzo's page to find out which essays I would most likely be working on in the final couple days. I was trying to find the specific sub topics in the subjects. Ok for the February 1999 Civil Procedure question, I was having trouble because I had not been forced to go into deep analysis for each of the factors of minimum contacts. Other questions I dealt with allowed me to just briefly mention each factor. However this question is good for going though Purposeful Availment, Foreseeability, Fairness, Relatedness, Convenience, and State Interest.
The other thing that was confusing me was that the contract in the problem was negotiated in a foreign country, but the performance of the contract was to take place in State X. The sample answer concludes that even though the contract was negotiated in the foreign country, there were sufficient minimum contacts because the performance of the contract was in State X.
Anybody want to chime in?

The first part about state's general jurisdiction was background stuff, useful for later when talking about residency of parties. It could have been discussed later, feels somewhat out of place this early.
You can see the RULE [A court has pers[onal] juris[diction] if the defendant is a resident, consents to juris, or is subject to the State’s long arm statute and meets the constitutional minimum contacts test.] The subsequent paragraphs are application of the rule to each party.
Removal of Case
Here we're getting into mini IRACs. This is the MAIN RULE. This created additional issues (can a federal court even hear the case? it depends on whether there's FQ or diversity).
[A defendant may remove a case to the federal court in the state where the claim was
filed provided the case could have initially been filed in federal court and the claim for
removal is brought by all defendants within 30 days of filing of the complaint or the
pleading which triggered the right of removal.
A Federal District Court is a court of limited jurisdiction, thus it may only hear claims
based on federal questions (arising under the U.S. Constitution or statutes) or claims
based on diversity of citizenship.]
Diversity Jurisdiction -- THIS BEGINS ANOTHER IRAC
The answer recites a rule for DJ: For a federal court to have diversity juris the plaintiff must be of diverse residency from all defendants and the amount in controversy must exceed $75,000.
Here, the answer analyzes two elements of the DJ rule, creating mini IRACs.
District Court’s Refusal to Remand to State Court -- IRAC and CONCLUSION (this could have been up top because this brings up the actual issue about remand from the call)
The federal district court with proper jurisdiction may refuse to remand a case to state
court. [RULE] In this instance, the federal court had federal question jurisdiction [ABOVE ANALYSIS BECAME THE "FACTS" TO APPLY], thus properly
retained jurisdiction.
So in sum, the structure is like this: IRA-[IRA-irac-irac]-C (removal - DJ - party diversity - AIC - remand was improper)

kind of shocked that barbri's CMR civ pro section doesn't mention mental or physical examinations as a discovery tool. looked at the feb 2015 exam, and realized i would not have been prepared to answer question 3 that specifically asked about this. freer talks only briefly about it in his lecture handout.

I haven't come across much of this. I have noticed that this issue came up in another civ pro question (February 2009 Essay 2) and so if you practiced that question you would have it in your additional notes. Does a premarital agreement classifying all wages as separate property of the earning spouse affect either a Pereira or Van Camp analysis? If there is a business that was created with separate property and later improved due to market conditions, can we say that the analysis is not affected by the premarital agreement?

Anyone else who is taking or took Barbri know how to interpret scores, as in how accurately are they graded. I don't know any classmates taking the CA bar and since most of them are doing UBE I can't compare. A friend who is doing UBE told me they got a 3 and that is apparently what there friend told them everyone was getting last year. Pretty underwhelmed with my feedback on the first PT.
