I'm fairly certain you were right. It's a somewhat rare case I suppose, but it seemed like the question was screaming at you to head in that direction, and they usually won't throw in a bunch of facts to induce a wrong answer.
if a painter can delegate his duties (can he? yes he can, cm' on, whats the homeowner going to argue, "I want your personal painting style and skills") why isn't possible for the other party to assign the K in a way that does not alter the painter's obligations.
My only explanation is involuntary servitude haha. You can't force someone to perform a service they didn't sign up for. Though I feel like there's an area of law somewhere where you can order someone to do something they didn't sign up for. So, idk.

Maybe in some jurisdictions you can't assign, but for Barbri, and in terms of the MBE tomorrow, you definitely CAN assign. Go to, I think set 6, maybe 5, of Contracts, the MBE question with the assignment and the different provisions - question asks which provision will be invalid or something. Something to do with railway companies I think

Assignments are allowed unless they change they change the risks or obligations, for example because of an indemnity provision they would have a higher exposure to indemnity

The fact that people are still arguing over the rules and analyses pretty much demonstrates how difficult the exam was. Last year, the general consensus walking out seemed to be that the MEEs were easy. The near-unanimous consensus here is that they were difficult and almost impossible to write in the allotted time. I expect a good scale for all of us.

I got buttfucked by word limit a few times. All that practice just outlining made me forget how tight the wordlimit could get

Spent a ton of time trimming down what I determined might be less important rules

sry guys. didn't mean to scare you. I was not NY, but other UBE state.

every UBE sets a different limit/no limit. I think my state was probably one of the lower ones. really obnoxious when combined with the strict time limit

also, wish I did that stupid LLC question last. (and according to effecientbarprep, A&P was their lowest chance of showing up topic lol)

That was like the one question topic I reviewed probably the least. Ran out of time on the secured transaction question which was so straight forward

Response from efficient bar prep:

I am sorry the predictions turned out the way they did. We feel horrible about it. The previous times we have been very successful, the NCBE just went against everything they have ever done. Again, I truly hope you pass and Good Luck tomorrow.

Hey guys, I know that shit was rough, but just a quick reminder to please refrain from discussing specifics of test questions. Not directed at anybody, but an FYI.

Nope, I think they are trying to start making money on some of their materials soon though. Predictions didn't work out, but I appreciate that they still try to help test takers with their knowledge. It's nice of them and they've been pretty good in the past.

Is this a joke? Because I had no idea WTF a construction mortgage was or how that interacted with a PMSI on a fixture...

Seriously? What are you waiting for?
