the instructions said to address the issues that were raised in the motion to vacate. So that is what I did and every issue that has been discussed was there.

That is exactly what I did and how I structured it.

(1) Strange BS Latin Doctrine
(2) The time table
(3) The (a)(b)(c) argument
(4) Aribtration law is bull shit.

Well yeah that was the point-you go through each ground in his petition and make a persuasive heading countering that.

Like one heading for untimeliness-then the relevant case law+analysis
One heading for Punitive damages-then case law from Monroe case
One heading for the non-officios or whatever that was plus case law
Forget what last heading was but it had the sub issues re attorney fees and something else.

I feel the need to continue the bar exam in some way. I don't feel finished. I still feel like I have to study. The "it's over" feeling hasn't kicked in yet.

I don't have any good stories, but I got a good laugh at Santa Clara once the test was over. Throughout the three days, the big hauncho proctor kept on saying, "Quiet down!" when people started talking too loudly. Once we finished the exam and all the exams were collected, people started cheering and clapping. Then big head hauncho started yelling at us, "Quiet down!" Something was just ridiculously funny about it. I think the whole convention center got a big laugh.

Ok good but majorly f'ed up on the headings. I used the damn 4 points they raised in their petition as each of my headings. My analysis was ok (I think) but I f'ed up on the headings. How screwed am I? I think I screwed up big time since I didn't follow directions.

So far I haven't seen someone else post this, but I analyzed it using contracts, since it seems more like a contractual relationship to me. There was no charitable trust to speak of. For the trustee to sue the beneficiary, it seemed like it was a contractual (perhaps oral) agreement that agreed how to use the funds. Am I crazy?

After Tuesday with the bar exam in Santa Clara, I went to Great America -- i.e. a big amusement Bay Area kids go to when they are 10. It's just a couple of blocks from the convention center. I guess that counts as Disneyland?

This evening, my parents dragged me out to dinner, and I was so crabby inside. I just wanted to go home, rest, and watch an excessive number of K-dramas.

How was there no charitable purpose to the trust?

Here's a horror story for ya. My hotel had bedbugs. I woke up Tuesday morning covered in bites. Turns out I am extremely allergic to these bites. They still itch like hell right now as I write this. I took the exam with 74 (yes I counted them) bug bites all over my hands arms and neck. Got very little sleep but took it anyway and made it through to the end. I figure if I failed at least I have a pretty good excuse.

I don't believe a charitable trust could have a dual purposes, half for non-charitable purpose and half for charitable purpose. There was only one trust, not two.

Yeah. It was a nightmare. It was Quality Inn Ontario. Thankfully they refunded my money and I moved to Holiday Inn. Although money was the least of my worries at that point.

Anyway to everyone worrying about their performance I think you can make some mistakes, even a big one here or there, and still pass. I know I made some given my situation. But it's normal to critique every mistake and forget about all the things you got right that could very well compensate. Have hope!!!

Seriously, both of you who were at that hotel, if you had your luggage on the floor or by the bed at all, don't bring it in your home. They migrate at night into your bags and then you can infest your entire house. Saw the most grotesque documentary about what happens when you return from a bed bug hotel. So sorry you went through this. Unpack outside, wash your clothing immediately and let the empty bags sit outside in the direct sun for a good week.

How do I know that I have them in my suitcase or clothes?

The Ontario convention center had a big archway sign that you walked under to go into the test room that said in big letters "You are entering the most fun place on earth."

It felt so you of place as we shuffled in after lunch in a big mass of tired hot sweaty angry exam takers. Clutching our ziploc bags and trying to not scowl at the woman checking our tickets under the banner.

I am honestly not equivocating the two, but my mind this morning read it as "hard work means freedom" before I blinked and read it correctly. Again - not even comparing the two - but talk about some crazy fruedian shit. Never had pressure get to me like that. Very glad its over... I hope.

The bugs are visible to the naked eye. I would suggest getting some diotamacious earth and powdering your shit down for a day prior to taking it inside.

They get into the lining and any nooks in the case so you might not see them. God, the documentary I saw showed these people's couch just infested when they turned it over. They had left their luggage on and next to it after travel. At night they migrate all over the place. Worse than cockroaches.

I was at Ontario. Tuesday after the morning session they kicked me outside the convention center after I bought lunch there. So , I and other examines looked for shaded areas until they opened the doors to let us back in. That was not fun. However, on Thursday after the morning session they allowed us to stay in the center at an area adjacent the door. did I miss this nice a/c area Tuesday or did they change the rules on Thursday?

I check my

You are likely okay, I would just be careful.

The person who got bit needs to be really cautious though and likely treat his shit with DE, boric acid or pyrethroids. I know I would, once those bugs get a foothold they are hell to get rid of.

Seriously? What are you waiting for?
