I would just like to add that the Philippines apparently publishes the top ten exams with name, grade, and school.

The good news is it should be very easy to get all the info I need to study onto one sheet of paper, at most, for Partnerships.

Yeah I liked the emphasis in crim law about how homicide requires the victim to be alive before they're murdered. Important element right there thanks Themis!

Don't feel this way

Gunnerism and over-studying, tho often seen together, are two distinct subjects. Gunners are the kids in class that always raise their hand for every question or, when called on, go beyond the question to espouse their own personal belief w/r/t the subject. They also over study, but only so that they can further the aforementioned trait. There were probably plenty of people in your class who barely spoke but still kept up with all the readings and studied diligently

This Tyrell, like all Tyrells, greatly overestimates their ability

Like--this test isn't just the difference between a B+ or an A. This test is literally whether or not you can practice law--something you have been spending hundreds of thousands of hours and hundreds of hours of labor to achieve.

A motorcycle enthusiast purchased a custom-made motorcycle from a boutique motorcycle shop. The enthusiast paid $5,000 for the motorcycle, which was to be delivered to him in one month. One week after he purchased the motorcycle, the enthusiast decided that he no longer wanted the motorcycle. He called up his best friend and told him that he would give him the motorcycle when it was finished. The enthusiast also instructed the shop to deliver the motorcycle to his friend. Three weeks later, the shop delivered the motorcycle to the enthusiast. The enthusiast accepted the motorcycle without protest. When the friend found out, he sued the shop for its failure to deliver the motorcycle to him.


Will the friend succeed?
ANo, because an assignee cannot force an obligor to comply with an assignment by the obligee-assignor.

I got this right after thinking about it for a solid 3 minutes and was almost positive I had no idea. This is one of those crazy ones where you have to put multiple pieces of the puzzle together in order to get the right answer. I really hope there aren't many of them on the MBE

I fucking hate Birdthistle. You can never tell when he's actually filling in the handout, I end up crossing out shit constantly. And why are his the only ones where I have to fill in a whole paragraph and not just a key phrase.

IL civ pro lecture handout was really bad, too, essentially all blanks. Really annoying.

Observation:

My first two Mixed MBE Practice Question sets were below goal (~50%). I took these in "Interactive Mode."

I planned to take the 3rd set of mixed PQs today, expecting failure. I even scheduled in 30 minutes of sulking in my daily schedule.

I just took the third set of mixed PQs in "Test Mode." Scored 10% above goal.

Not saying that's the reason why I did well, but, I mean, a 20% difference is pretty substantial.

Yep, I'd go through the same exact cycle. Now, in test mode, I'm just in a perpetual loop of anxiety, which is much more stable and consistent.

I'm a day or two ahead of schedule (UBE only) at 55.6%. After today, I will be at 57.2%.

10 Weeks... So 10% per week. so just figure out how many weeks have gone by.. and multiply by 10 and that's what percent you should be at

Almost the same. At 58.2% now in UBE only, will hit maybe just above 59.0% today (finishing secured transactions lectures + assessment still).

Yeah okay Themis. I can do all the Secured transactions lectures, summarize my notes, do a secured transactions essay, do 34 con law questions, do a 50 question mixed PQ set and also assess secured transactions all in one day, but tomorrow I'm just scheduled to do the Wills section and only one 50 PQ set?

What factors do you look at when determining whether something arises from the same set of circumstances as another claim?

Some MBE question was about a woman suing her plastic surgeon for a botched surgery on the basis of failure to obtain implied consent and then later attempting to amend her complaint to include a claim for negligence. The answer said that the negligence claim did not relate back to the implied consent claim.

A question from milestone 2 set was about supplemental jurisdiction over pollution of a stream claim under the federal Clean Water Act and a state law nuisance claim said that the court had JX because the 2 claims arose from the same set of circumstances.

How was the surgery not from the same set of circumstances?
At this point, I just do not understand what is and what is not considered "same set of circumstances." Any one able to clarify this for me, please?

Just did MBE Mixed Session 3. Had done the first 2 in interactive mode, but decided to do this on Test mode. Got 66 and 74 on the first two, but then fell below the goal score with a 58 on the third session.

Was there a consensus that session 3 was any harder? I'm guessing it is more likely because of my switch to test mode and not being able to review my answers between each question. Discouraging nonetheless.

I have the same thing. Today was just 2 essays and 2 "review x subject". tomorrow is 5 essays, 8 videos, review 2 subjects.

Here's a question for everyone. I'm making my flashcards outside of my scheduled Themis time because I like to summarize when the information is fresh. When Themis only gives you ~4 hours of work in a day, do you do more?

Seriously? What are you waiting for?
