Yeah, Themis wants me to do the MEE today, which I know I'm overdue for, but I feel like I'm gonna give a particularly shitty performance. Might just work through the agency and partnership stuff, and a few PQ sets.

Is anyone else finding themselves waking up in the middle of the night and thinking about Bar shit? I woke up at like 3am last night and couldn't stop thinking about supplemental jurisdiction.

edit: started watching Agency, "that third-party is going to be called...the third party". Goddamnit Birdthistle not today.

I am finally starting to feel comfortable on some essay subjects. I did my fourth Agency essay today and I was almost able to answer the whole thing without looking to my outline for clarification. Similar progress on Corporations today. If y'all have been skipping the essays, I recommend to start doing them.

Also, I messaged Themis about whether MBE tests more on general concepts or on the nuances. They said the MBE tests more on the nuance, and the essays test more on general knowledge. Which means I won't be surprised if we have a lot of MBE questions that are on exceptions to general rules--or exceptions to the exceptions! FML :twisted:

Definitely had a stress dream that it was the day of the bar exam and I had only studied the MBE topics and never gotten to the state specific stuff.

Also got stuck in an elevator the other day with my 10 year old daughter and a stranger and started rattling off the elements for a prima facie case of false imprisonment. That did not seem to calm my daughter down, oddly enough.

Do they give out awards for top scores on the bar exam? Like cash prizes or something you can put on your resume?

Yeah. I think so to. I think I have learned most of agency law simply by doing the practice essays with an open outline

Once you get the hang of it, it's actually kinda simple. The only areas I have seen tested are: (1) does an agency relationship exist; (2) does contract liability stem from actual authority, apparent authority, or estoppel; (3) is the agent an employee or independent contractor; and (4) does tort liability stem from actual or apparent authority

I have done 4 practice essays, and number (1) and (2) have been tested on every single one

It doesn't seem particularly complicated, the actual layout of the handout/lecture is just irritating me.

I just wanted to come here to again complain about the whole Themis Best Evidence Rule mind games. Spoilers for Mixed PQ 1:

It happens again!

A plaintiff sued a defendant for breach of contract. The plaintiff claimed that she had ordered 250 widgets from the defendant and that the defendant had only delivered 150 widgets. In his answer, the defendant claimed that the plaintiff had only ordered 150 widgets. On the witness stand, the defendant testified that the plaintiff had ordered the widgets by filling out a purchase order form provided by the defendant. The defendant’s counsel then asked the defendant “What number did the plaintiff fill in on the form for the number of widgets ordered?” The defendant answered “150.” The plaintiff objected to the question, and asked the judge to strike both the question and the answer.

How should the judge rule?
ADeny the motion, as the statement was made by an opposing party.
BDeny the motion, as the statement falls under the exception to the hearsay rule for records of a regularly recorded activity.
CGrant the motion, as the best evidence rule applies.
DGrant the motion because the statement constitutes hearsay not within any exception.

Tbf I do feel pretty gunnerish studying 5-6 hours almost every day and being on track for 100% completion, I never studied like this before and even by Themis' own standard it's probably overkill.
