Never need to cite cases! If you're absolutely positive you know the case name, you could include it, but there's really no need.

Curious:

How often do you all, like, go outside and do something. Like go to a restaurant or movies or something?

I'm wondering how much going out is too much.

Yep, exactly this. Look back in this thread at the discussion we had about the stupid Best Evidence Rule advice Themis gives. Themis says explicitly that the BER is almost always the incorrect answer in an MBE question, and harps on that fact that it only applies in a super narrow circumstance where two factors occur.

Cue Evidence MBE PQs. Almost every question in which the BER is an option, BER is the correct choice. Like, come on Themis, test rules, don't beat me over the head with your advice and then come back and punch me in the gut for following it.

Going out to dinner quite a bit - it's faster than shopping and cooking (family of 5 here).

Paying a babysitter right now to take my kids to Finding Dory, which is bumming me out.

I won't go into more of a hermit mode until July 10th (we've got 4th of july plans and my son's birthday is July 9).

In some ways I'm more stressed out because I cannot ignore my children, so I'm definitely more distracted than last time I took the Bar. On the other hand, passing it in VA gives me some confidence (it had more topics than MD does) and worst case scenario is that I have to commute to VA and DC, which I'm already barred in, I'd just rather work locally.

Honestly, you're not going to flunk the bar because you go out to dinner a few times a week (unless going out to dinner means your out till 1am drinking? That might hamper the next day's studying!).

At least on week days i try to go the gym for an hour in the late morning and then to the pool (where i may still read the long outline) for an hour in the afternoon. I don't really study after 6 or 6:30 on weekdays and at least some of those days I'll get out of the house in the evening. On the weekends I basically haven't changed going out places or doing activities with friends/families, but I'll try to stay on schedule by getting everything done before or after I go out. I'm at about 50% completion right now, and I don't see my schedule changing a whole lot.

If you aren't working part or full time I have no idea why bar prep would keep you from doing stuff over the summer (aside from week long trips where you don't have internet).

Jealous of whoever is seeing Independence Day 2 I had no idea judd hirsch was still alive.

So just got a response re: special notice and the required notice.
[+] Spoiler
The purpose of a special meeting is required in the notice for a special meeting of shareholders. The purpose of a special meeting is not required in the notice for a special meeting of directors.
I'm going to respond with something along the lines of how df were we supposed to know that (but of course nicer) . The outline doesn't even have a section for notice for directors meetings. Mentions nothing about what the requirements are.

If it weren't for torts and property, I'd be at about 75% on MBE. I haven't had time to review much b/c of work, so hopefully when I stop for full-time bar prep in July, I can get over this hump, but its just really frustrating.

So that one evidence essay was basically half crim pro, huh?

Also, I am really struggling to get myself to do a 34 question Property PQ set. I thought I liked property at first, but fuck that. Every PQ is the length of an essay question.

edit: seriously, fuck mortgages

I have a question about a question from crim law PQ4:
[+] Spoiler
My question concerns the question about the person who sees a package fall off of a car, intends to return it to the owner then later decides to keep it. The answer choices were (1) larceny, (2) larceny w/possession of drugs,(3) possession of drugs, or (4) neither of these. The correct answer was neither of these because it was a continuing trespass.
What would the crime be then?

Maybe petit larceny (not tested on MBE) but it's not common law larceny

Fuck subjacent support and lateral support rights, and those different standards for when strict liability ends.

I would contact them. I'm UBE (NY) and Wills is my last essay. Today's graded essay is an MPT for me.

Are you behind schedule? The graded essays are based on the regular schedule

RE Graded IL Civ Pro essay
[+] Spoiler
Holy shit I just blew a graded Civ Pro essay. It was about personal jurisdiction. I read the fact pattern and started typing away. I didn't remember reading that the defendant had filed an answer before filing a motion to dismiss for lack of jurisdiction. I got two of three questions wrong solely because I missed that fact. My analysis was perfect if the answer had not been filed. I felt really comfortable writing this essay because I have retained civ pro stuff pretty well and didn't reread any part of the fact pattern because I thought I had properly digested all of the material facts. I was wrong. Fuck meeeeeeeeeeeeeee ugh. This feeling is even worse than not knowing an answer

I've done this on essays. I write out an entire "perfect" answer, then look at the facts real quick and realize nothing I wrote answers the question or is completely irrelevant because of a single sentence.

Yeah, this happened to me with the graded evidence essay when the lecture was scheduled for the following day. I just skipped it and it bumped it to later in the week.

It's that law school exam training in us. It helps me to look at the questions, and make a short outline to the questions before I read the fact pattern and then just bullet the issues that come to mind.
