I took two classes on the First Amendment and I knew the answer to this only because of that. Mean question to ask, Barbri. Mean.
that was so brutal. there's no way to know that unless you knew the specific case because it definitely does not meet the lemon test.

I read somewhere that the marking on essays is relative to how others perform - can anyone confirm?

Anyone do the barbri half-day 100 questions? Finding it hard and freaking out.

yes, found it similarly difficult to refresher, and harder than the practice exam.

also first half is harder than the second IMO

yeah the half day one was brutal. I'm finding the full day one to be more manageable

Yeah I got like 65/100 on the half-day when I've never scored less than 70% on any mixed-subject set before, including the refresher.

Yes it was absurdly tough. Got 71/100, which was way worse than the refresher. Barbri is making me nuts.

+1

If 71/100 is frustrating you, I have an feeling you might be way over-prepared for this thing.

Yeah I missed 10 property questions. It's my worst subject by far, but that was a bit excessive.

i got similar and got 148 on the simulation.

half day is harder / more obscure i think. i ended up with 66-67 - second half is easier.

I had 146 on the simulation and my average on Adaptibar for the last 250 questions has been 78%. What you're experiencing is barbri's scare tactics.

edit: forgot to mention that 78% is including civ pro's 65%. Adaptibar's civ pro questions are pretty bar, some are difficult but others are simply badly written. There's absolutely no reason to doubt you would be getting 80%+ on a set of real NCBE questions.

I think they're making the questions harder as we go along. I did great on the simulated MBE, not so great on the 100 refresher. Until the exam I'm just doing the 400 questions from the NCBE. They have a few hard ones, but overall its much better than barbri, I must say. And some are blatantly obvious too, THANK GOD lol

How are you guys preparing for the essays? And is anyone focusing more on the predicted essays? I'm focusing on corps, trusts, wills, family law and agency. For the MBE ones, focusing on Civ Pro mostly, and reviewing some property and contracts, possibly torts if i have time

"Thus, abandonment can not act as a good defense. Choice C is incorrect because withdrawal is not relevant to the crime of larceny." No shit, that's why I picked the choice saying withdrawal is not a defense to larceny.

Where do you find those questions?

I've been in the 60% with occasional the 70% on barbri mixed sets/refresher/simulated, and want to get a more realistic picture of where I might stand.

The NCBE website sells them, but I bought a book that has them all. Also, my school made this video on what to do if you don't know the rule for an essay. I found it helpful, and funny, so I thought I'd share :)
