subject matter jurisdiction

Post by leroi » Fri Jun 22, 2012 3:21 pm

the case - after an evidentiary hearing a listed petitioner is granted an injunction and it is later discovered that the petitioner did not sign their original ex parte petition. Signing the ex parte petition under oath is a statutory requirement. Does this constitute lack of subject matter jurisdiction thus making the injunction voidable?
