Self-Assigning a Writing Sample?

Post by Anonymous User » Sun Apr 05, 2020 6:42 pm

I'm a 2L hoping to apply to federal clerkships this cycle (think CDCA, NDCA, DDC, SDNY, 2d/9th Cir.). However, I don't have a suitable writing sample, and (contrary to my expectations) likely won't be producing one through any classes this semester. The only piece of legal writing I could even possibly use would be an assignment from my 1L writing class, which I really want to avoid. I'm applying to my first-choice judges this cycle, with the thought of applying more broadly next year if things don't shake out.

Grades-wise, I was in the top ten students at my T6 after 1L, but I bungled last semester and likely dropped out of the top 10% (my school doesn't publish GPAs or rankings). No grades this semester. I also have a great recommender who is willing to make calls for me. Basically, I feel like I have a good chance with the judges on my list, and I'm worried I'll sink my chances with a poor writing sample.

Is it insane to just write something on my own? Or should I consider using/reworking my 1L memo? Should I just wait until next year, when I will have a proper piece? And given I have a generally strong application otherwise, how important will my writing sample be for making the cut?

Thanks!

If you want to self-assign a writing sample, that's fine. Just make sure it's well written, not controversial, and a good piece of analytical writing.

At my school, you could get a credit for independent writing by working on a piece with a professor. That way you get feedback from an expert and get to know someone to recommend you, and you get a credit if you want to pay and can likely publish somewhere. They can also help you think of a topic.

I think that as the primary sample, with the punched up 1L brief (I know not great) as a backup showing your brief-writing skills would be a much better combo.
