Have a SA lined up for the summer, but want to extern this coming fall. Large District (SDNY/2nd Cir., ND Ill./7th Cir., ND CAL/9th Cir., etc.). I have already externed for a district judge and loved the experience. I want to hopefully extern for a Circuit Judge or another District Judge. However, I just received an interview offer for a magistrate.
I want to hold out and see if I get an offer to interview from district or circuit judge. Do I have a play here? If i take the interview, and get the magistrate position, I obviously cannot decline the position.
Any thoughts would be appreciated.

I'm a law clerk in a well-respected district in 2d/9th. Don't extern for a magistrate judge if you previously externed for a district judge. It looks like, and is, a big step downward.

Another current district court law clerk. Definitely agree.ResIpsa21 wrote:I'm a law clerk in a well-respected district in 2d/9th. Don't extern for a magistrate judge if you previously externed for a district judge. It looks like, and is, a big step downward.
In our district, the magistrates choose from the extern applicants who were rejected by the district judges.
