Clerkship bonus advance?

Post by Anonymous User » Tue Mar 04, 2014 12:45 am

After a long and frustrating application process, I'm thrilled to have recently accepted a district court clerkship that starts in 2016. Does anyone know if firms ever will advance the clerkship bonus sometime during your year as a clerk? I will be leaving to clerk after two years of working at a big firm and would love to try to mitigate the pay cut. While I know this is two years out, it makes a big difference now as I start thinking about what my loan repayment schedule will be and what kind of rent I can afford.

Thanks!

You can't receive a bonus during your clerkship, since that could give rise to the appearance of impropriety.
CANON 2
§ 2. Avoiding Impropriety and the Appearance of Impropriety
§ 2.2 Additional Compensation for Performing Judicial Duties
(b) A prospective law clerk may accept, prior to commencement of the clerkship,
a signing and graduation bonus from a future employer when it is clear that the
bonus is not paid because of service as clerk. A clerkship bonus may be accepted
only after termination of the clerkship, and no bonus of any kind may be accepted
during the clerkship. See Advisory Opinion No. 83.
(b-l) A law clerk may accept from future employer reimbursement of the
costs of a bar review course and related fees, as well as a stipend to permit a period
of study for the bar examination prior to commencement of the clerkship.
