Assignment and Delegation in Contracts

Post by HabeasTortoise » Sun May 11, 2014 12:41 am

I am a little confused by these two topics. Hypothetical, A owes B delivery of a ship, and B owes A fair consideration. A is late, but B does not revoke, and before A has a chance to deliver, B assigns all rights and duties to C.

My question is this. Is this an assignment, delegation, or both. B merely has to pay, and receive the ship. Is paying someone a duty or a right, and is receiving a good a duty or a right? This seems like a delegation and an assignment?

This is also from an old practice exam from 09.

It sounds to me like both. B has the duty to pay and the right to receive property / sue on the K.
