Con law hypos from recent events?
Anyone know of any recent events that might make for potential exam questions? In particular, any 14th Amendment related stuff?

How would that be tested though? From my understanding, that case is just about whether voters can vote to reject affirmative action programs.

gay marriage? altho lower court decisions are pretty unanimous in their ruling so far

As mentioned, there have been a bunch of D Ct rulings on state same-sex marriage bans in light of last year's decisions. Those will be bubbling up soon enough. I suspect the Circuit courts will be a little more divided than the districts, (at least the 5th).

My ConLaw exam last semester asked a question about this - under the (pre-Schuette obvs) restructuring doctrine, could Congress ban it and what implementation advice would you give to make the ban most likely to survive a challenge?1l2016 wrote:How would that be tested though?
