Missed this issue on Prop II final. Big deal?
Three part exam 1st part essay worth 40 points. Seven separate questions pertaining to the essay.
The first question was about about how the court should rule on whether or not the party can remove the easement. I didn't write that the party was subject to an easement appurtenant so it would run with the land to him (he was trying to get it removed). But I'm pretty sure I got how the easement was created in the first place (implication). So in sum, I may have gotten half of that question right? I feel pretty good about the rest of the test.

Depends on your definition of big deal.
Will you fail? Not likely.
Will your GPA and class standing take a hit? More likely than not, but you can overcome that if you take blowoff electives later on.
I wouldn't over think it. Wait until you start to post mortem the bar exam essays for 3 months..............now THAT is where the fun starts.

It's on the curve. Some bimbo did worse than you. A gunner most likely.

Depends on OP's definition of "issue". It could a small subissue, or a larger main issue worth many points for each breakdown.

True. No one here can really answer OP's question b/c a) we didn't take the exam, and b) the only one who decides OP's grade is his prof.
That said, he said the essay portion was 1 of 3 sections of the test (though no idea what 40 points means...out of 100? out of 120?), and the essay portion had 7 questions on it. If one of the 7 question was this easement question, and the rest were on various other things, it seems more like a sub-issue of the larger easement issue, and thus might not be as important.

I think the breakdown was 40 points for the essay, 30 for short answer, 30 for MC. And yes, the seven essay questions were not cumulative.

I just took a Copyright Exam and there was not a single fact in any hypo that could be used to test the "display right" cases we learned over the course of ~2 1/2 classes.
It seems more likely to me that my teacher is incompetent than that I missed it.

I just had a 3 hr exam with the question count equivalent of a 7 hour one the other day. I know I left major issues on the table, but there was nothing I could do about it. Try not to dwell on it too much. It'll just drive you crazy.
