Remedial Legislation w Invidious Discrimination Principles

Post by hangnail » Sat May 03, 2014 2:25 pm

My last exam of 1L year is con law so I'd like to go out with a bang.

Difficult: I'm having trouble organizing an attack plan for remedial legislation (ex. affirmative action-please disregard the most recent decision on the topic) whilst staying true to some of the principles put on the table for "invidious" discriminatory legislation. Do these two things not overlap? Should I just keep them separate? Or is there something that ties them together?
