I need HELP on Torts policy exam PLEASE

I got torts exam on Friday, and my professor just sent out an e-mail saying that it'll be one big issue spotter and one big policy essay. I honestly have no clue how to write torts policy exam and in need of some major help. What are some possible topics/how should I answer them? Maybe a good torts outline with policy stuff on it? Please save me from a sure B-/C+ guys......

It's similar to an issue spotter with policy arguments thrown in.

See if you can get your hands on Getting to Maybe - its policy section helped me knock out a Torts policy question with ease.

Also, your prof should have made it pretty clear over the year about what is important from case policy. Did she cover the Hand Formula? When looking at the Hand Formula, was she doing weightings of intangible injuries or attempting to assign dollar values?

Did she often ask you all to look at the broader application of the law to the public? In a financial or social harm sense? For me, it has always seemed that policy comes down to an argument about those sorts of principles. Efficiency v. Justice/Cost v. Burden. If you can frame your issues in a clear way from the outset, you should be able to do well. YMMV, though.

Also, always remember - it's a curve, your classmates are just as freaked out.

Policy questions like: contributory vs comparative negligence, theory behind proximate cause, tort reform and caps on damages? Because I have a short outline on that.
