The hypo is this:
Prosecution wishes to offer a videotape, made secretly by W at
W’s home, in which the defendant is seen in a
ceremony in which he knelt on the floor swearing allegiance to Al
Quaeda and “Death to America.” Visible in the background are blow-up
photos of Osama Bin Laden (the avowed leader of Al Quaeda whose
image often appears in print and other news media) and of a plane
crashing into one of the World Trade Center Towers on September 11,
2001.
What issues do you think would be raised by this? Especially curious about the videotape... Would this count as an admission?

Hearsay, offered for its truth, best evidence rule, authentication issues, trustworthiness of the tape, and probably others.
