New trial, in the alternative.

I found a hypo that says okay, decide if the JML was granted properly. Then, decide whether our alternative motion for a new trial was proper.

I thought alternative motion for new trial was granted when the jury verdict is against the manifest weight of the evidence -- leading to a miscarriage of justice. How could I determine whether it was proper when it hasn't even gone to the jury yet?
