Meh, who knows in torts? People after the test started discussing answers. I ran away from that so quickly. What's the point of discussing answers if no one definitively knows what the right answer is? This isn't Math or even Econ.

Got a solid second wind today after an innitial burn out after Civ Pro.
Anybody happen to have an attack outline for Property? Specifically Merril/Smith Property: Principles and Policies? I would owe you big.

For anyone taking CivPro, the Freer supplement is really readable and updated with all the new rules. I was getting nervous with Glannon because it's old and straight wrong about some rules due to the updates since the book came out so I got Freer and I'm not disappointed at all.

The closer I get to taking my first final (on Monday), the more I realize how damn arbitrary grades are really going to be. Honestly have no idea what I'll end up with.

+1, everyone in my section is really smart...i have no idea how the prof is going to decide between everyone's answers (he said he doesn't do it based on a checklist, he tries to glean our understanding of the issues based on a lot of factors and then grade based on that)

All 3 of my professors grade completely differently, which has made exam prep a bit... interesting, since I haven't been able to focus on anything in particular. One uses a checklist (but will give points for good things not on it), one gives points for whatever they read that they like, and the other really cares about our organization, prose, and spelling/grammar. Sigh.

Can anyone recommend me a good supplement for understanding the conceptual issues with damages for contracts? Any of the supplements stand out? I have a good rule chart with when to use the different forms of damages, but I want a fuller understanding of how to calculate them when you have a long hypo with a lot of potential damage calculations...so maybe a book with a hypos and answers?
I only have 2 previous tests, so I want to reserve them for later.

Hey guys. Question.
When writing your torts exam and it says to define all potential P's or D's or whatever. As headings do you do:
Potential D1
Duty
Breach
Causation
Damages
Defenses
Conclusion
If that is how you split it up would it be better to put defenses before Damages? I know thats not "how it goes" but I feel like it can make more sense. Thoughts?

depends on your prof probably. For mine he didn't teach damages, and also spent minimal time on duty. Our model answer didn't even mention duty unless it was relevant in the fact pattern. Our prof kinds taught duty breached interfused with duty. So I usally just organize the different duty breach standards under headings.

Took Torts today. 5800 words in 3 hours. Was practicing at about 1500 words/hr until this last week. Kicked it up to 2000/1800/2000 with adrenaline/focus/practice for the final. Also reading the chapters in the Torts E&E on exam taking was a HUGE help. Highly recommend those.

By the way, did you talk about defenses before causation or after you finished causation? I just geared my typing to 1250 words in 40 minutes, so I feel good. Just keep practicing and you will do more and more.

Haven't done much yet today. So planning on spending the rest of the day in the library. At this point the scariest thing to me is I know how abitrary grades will be. Sigh.
