Con Law Big Picture Issue spotter

Post by tydurden » Fri May 04, 2012 1:43 pm

Just informed my con law exam will have 100 point "Big Picture" issue spotter in addition to a regular 105 point issue spotter.

Any idea what "big picture" means?

I'd say overarching themes like federalism, separation of powers, proper scope of judicial review (deference vs activism), originalism, framers intent, etc.

Basically, my guess on big picture would be pulling out of the details/facts of a case to say "this implicates a separation of powers concern because..." rather than attempting to do fact-to-fact comparisons to specific cases.

But hey, your guess is as good as mine.
