NY Murder in the Second Degree

Post by SKlei » Wed Dec 14, 2011 9:26 pm

can someone please explain the affirmative defense, i'm a little confused. I get that if they act under EED it goes to manslaughter in the first degree, but what about depraved indifference and felony murder in section 3. what happens then?
