Applicability of a Statute that imposes a duty in torts

There are three:
1. Negligence Per Se
2. Prima Facie
3. Evidence

I understand the difference in their weight, but why is there a difference? Is it based upon the jurisdiction?

Depends on which approach has been adopted by a particular jurisdiction. I think a majority of jurisdictions adopt the first approach but not 100% sure
