Am I wrong in thinking that Nicastro didn't really change much, but rather was an extension of Asahi, and also of significant notice is that it was a plurality opinion and not a majority?ph14 wrote:Wal-Martrocon7383 wrote:what are the cases that have changed civil procedure law in the past couple years that are not noted in some supplements? just looking for confirmation, Iqbal comes to mind.

Didn't two concur in the result, and thus settle it pretty definitively?

Sorry if this has been asked before, but how do you guys use flow charts? Do you refer to them during the exam or just when studying? Have a beautiful one courtesy of TLS, but not quite sure what to do with it lol

Re: 1L Exam Prep and Motivation Thread
meh, as best as I can tell, Nicastro didn't give any guidance as to which opinion/test (Brennan or O'Connor) we should apply from Asahi. It was just kind of a clusterfuck, with the concurring opinions taking hints from both tests but ultimately deciding not to subject McIntyre to NJ jurisdiction. The stream of commerce subset of personal jurisdiction still seems to be largely undecided.kalvano wrote:booboo wrote:Am I wrong in thinking that Nicastro didn't really change much, but rather was an extension of Asahi, and also of significant notice is that it was a plurality opinion and not a majority?ph14 wrote:Wal-Martrocon7383 wrote:what are the cases that have changed civil procedure law in the past couple years that are not noted in some supplements? just looking for confirmation, Iqbal comes to mind.

Somehow, it took my actually sitting in the exam room before the exam started, looking around at all my classmates whom I like and respect, to realize that half of us are screwed regardless of what happened for the next 3 hours.
Regardless of whether I win or not, f*** this system.

Only half? You must go to a good school.0LNewbie wrote:Somehow, it took my actually sitting in the exam room before the exam started, looking around at all my classmates whom I like and respect, to realize that half of us are screwed regardless of what happened for the next 3 hours.

Re: 1L Exam Prep and Motivation Thread
well, my school is pretty generous with schollies, so I figure, of the 80% of us who don't get big law, half will be able to scrape by on a crappy salary, and not be "screwed" in the sense that we won't be bankrupt.johansantana21 wrote:Only half? Yeah, don't get caught up in the "big picture" issues. You need to address them, but sometimes in Con Law it's hard to figure out the "test" to apply...but there always is one. Make sure you have the mechanics down. There will probably be an issue related to standing, etc., so make sure you know the step-by-step ways to analyze things.

Re: 1L Exam Prep and Motivation Thread
I'm not even done with finals and my professor for conn law next semester e-mailed us assignments for our first classes. Now I can't even be happy about finals almost being over because I have a constant reminder I'll have more work to do once they're done. He also scheduled his office hours for when we have another class. ha.

Re: 1L Exam Prep and Motivation Thread
Does anyone have any good reading/outlines/flowcharts to help explain express vs implied warranty in Contracts? I have a pretty good understanding but looking for some reinforcement before the exam next week.
Any assistance would be appreciated!

I have a pretty good handle on them (I believe) if you have any questions on them.

This is what I realized as well, and then I decided that I've pursued one system to it's limits, the academic system and it didn't go so hot.Dany wrote:I've never felt like more of a failure in my life. I just want to crawl in bed and cry.
New strategy, albeit a painful one: attempt the system of networking and steal a job that way.

Writing my practice legreg exam has made me realize that I thought I had a good grasp on the things I've learned in this class, but in reality I've learned absolutely nothing.acrossthelake wrote:Writing my practice legreg exam is made easier with a tab open for the U.S. Constitution. Is there anyone here who actually felt good coming out of an exam? Everyone here is saying they failed, which can't be true considering this is TLS...

I heard a guy say he aced the exam. Don't know if he was being sarcastic but he sounded serious.

I felt good about today, but also kind of bad. Definitely did not feel like a #1 exam, and the unrealistic goal was sort of to #1 torts and aim for median (realistic) in my other two classes. Sort of crazily cramming property now.adonai wrote:Is there anyone here who actually felt good coming out of an exam? a lot of people after my exam yesterday kept on talking about how it was easier than they thought it would be and it wasn't hard at all. it was easier than i thought it would be, but i still didn't feel good afterward.adonai wrote:Is there anyone here who actually felt good coming out of an exam? I felt marginally confident. And then it started to set in and I felt more and more unsure and started to second guess everything I did and now I don't feel so good. I also feel like I'm fucked on my other 2 exams.adonai wrote:Is there anyone here who actually felt good coming out of an exam? Yup same here. I walked out of my exam and asked my buddy "how did it go? pretty brutal huh?" to which he replied "it actually wasn't as hard as I thought it would be." Felt ok coming out. Hours later, realized abysmal mistakes regarding what I believe is a misread that influenced a 78% essay. I hate to say it, but at this point a c in said class would feel like a beautiful gift.crossarmant wrote:I felt marginally confident. Re: 1L Exam Prep and Motivation Thread
My Ks outline was a pretty manageable 7500 words or so (we split Ks in 2 semesters btw). I memorized most of it, and the rest I was able to flip to very quickly during the exam. My Crim outline is 16000 words. I've memorized incredibly little of it, just memorizing where things are on the outline is going to take a while. I'm gonna do one practice exam now and one in the morning (exam is in afternoon). Anyone have any advice for me?
