Witnesses and PJ

Post by TTH » Fri Jul 15, 2011 1:01 pm

I'm having trouble remembering a case from civ pro. I'm pretty sure there's a PJ case that states a witness can appear to testify in a case without consenting to PJ in that court. Does that sound familiar to anyone or am I making it up?

Hint: subpoena.

I think you can show up to contest PJ without your appearance constituting a consent to PJ. Don't remember stuff about witnesses though.

Found what I was looking for. It was some goofy S.Ct. case from 100 years ago.
