Evidence Supp

Post by TTH » Fri Jul 15, 2011 12:39 pm

I found some cheap Evidence E&Es at a used bookstore in town and am curious if they are any good. Have there been any big changes in evidence law since 04-05?

The biggest change is the restyling (which was approved earlier this year and goes into effect this December). While the restyling didn't change the substance, it does change some of the subsection numbering. This can bite you when citing the rule.

As for substantive changes, I'm not sure. We didn't spend a lot of time looking at how they had changed. In the few cases where we did look at the changes in the rules (like the codifying of Daubert) we didn't really pay attention to when the change took place, we just noted where the common law had influenced the federal rules or where the federal rules had supplanted the common law.
