Class Action Suit Filed Against Thomas Jefferson

They are being sued for misleading employment information. If the law students win this lawsuit and get what they are asking for this would seem to be enough to put schools like this out of business. It will be interesting to see how this goes.

Relief Sought
•Compensatory damages believed to be in excess of $50,000,000.
•Restitution believed to be in excess of $50,000,000.
•Disgorgement of all profits obtained by TJSL as a result of its unfair and fraudulant practices.
•Punitive damages.
•Injunctive relief to enjoin TJSL from continuing its unlawful practices.
•Attorneys’ fees.
•Prejudgment interest.

What are the fraudulent practices again? Are the brochures and whatnot factually incorrect or just presented in a way that makes the school look good, like an asterisks at the bottom saying only 20% of the class reporting. It will be interesting to see how much responsibility the courts put on the students who choose to attend TJ law.

TJLS at least had factually incorrect statements.

Beyond that, it's important to realize that 'caveat emptor' isn't the law in the United States. The kinds of statistical gimmicks (and asterisk usage, as you point out) are expressly illegal and would never pass muster on something like, say, a bottle of laundry detergent. They've definitely got a leg to stand on.

There are bigger issues though. The one I think might be fatal is that for a class to be certified they usually need to had strong commonality in their claims / damages / relief sought. Since some TJLS grads will be quite gainfully employed, that could throw a wrench into things just because of how class action suits work and not because of any strength or weakness in the underlying theory.

No the claim is that.... TJSL decided to count students who did not respond to their employment survey as being part of their 90%+ employment rate stats they sent to the ABA
