AT&T and T Mobile Merger

Post by memoryl0ss » Tue Mar 22, 2011 3:31 pm

Note that I am not yet in law school, so this is a curiousity question.

If the above merger, I have read twice that AT&T will honor the contracts of T Mobile subscribers. Could they unilaterally cancel or amend the contract? Assuming that the contract itself does not explicitly say that T MObile reserved the right??

I'm not sure this is the right forum for this question, but whatever.

Assuming the deal receives the regulatory seal of approval (and that might take as long as 12 months), AT&T would likely honor your current T-Mobile Contract. At least until your contract expired, at which time they would offer you a new contract under new terms. So at least for the life of your current contract, it wouldn't expect it to be altered or amended. I can bet you won't be able to renew under your current terms when the contract expires.

Whether T-Mobile reserves the right to amend the contract would depend on the language of the contract. But I wouldn't think that will be an issue.

It's also a matter of whether AT&T will allow new phones it brings it to be compatible with the old T-Mobile K.

Best to move this to lounge.
