Torts: Products Liability 402a. R2T vs. R3T

Post by stocksly33 » Wed Dec 08, 2010 4:43 pm

I'm a little confused on how to apply R2T and R3T. Is R2T only applied to manufacturing defects?

So the analysis of a products liability would be:
- Manufacturing Defect - R2T & R3T analysis
- Design Defect - only R3T analysis
- Failure to warn - only R3T analysis

I'm going to use R2d for products liability in general. If the issue is design defect or failure to warn, I'll just throw a sentence in about how R3d is explicit where R2d is not.
