Drifting Statues

So in my crim law class, one of the three Qs is going to be having us draft a statue on a topic, and we have to argue the rational for using the developed statue (we are also suppose to be arguing about why the crime should (or not be) be enforced in general). As a class we developed these ideas:


Issues to Consider in Drifting Statues

Definitions, Plain Meaning and Clarity of the Law
Enforceability
Overly Broad ?
Reasons for Criminalization
Theories of Punishment
Comparison to other Crimes
Judicial Discretion
Public Policy Rationales

any other topics that should be on the list? or why a law should or should not be enforced?
