Quick question
In regard to the False Claims Act, when you are filing say, a motion to dismiss according to 12(b)(1), in your motion heading do you still include United States of America ex rel. ______ , or do you exclude the United States as a party, if they have decided not to investigate the case of fraud. Thanks for the help.
