There is a lot of variables at play! How about trying to change one of them?

Re: Buy E&Es now?
You do realize that you're merely reading Dressler's opinions wrt criminal law (normative and his own twisted positivist descriptions). If your prof agrees with him point-by-point (which probably won't happen), you're fine (although I do agree w the tls majority that you are wasting your summer in that you could be reading something more productive). If your prof doesn't agree w Dressler, on the other hand, and you are not particularly astute, you are creating more potential for failure. To avoid this (assuming you are resolved to continue reading despite contrary advice), you can either 1) skim it lightly, whereby you retain nothing detailed but build a light schematic framework (of marginal use, which is one reason why the tls majority calls it a waste of time); or 2) study it intensely to the point where you can profile Dressler and then compare that (memorized) profile to that of your prof's. I did the latter, with great success, but I waited until law school to begin. The risk of forgetting anything you do now is too high; it's more efficient to use your available time now towards something that doesn't require memory but that alleviates the anxiety of beginning 1L in the fall, such as examsmanship prep.

I didn't even understand that analogy when you made it. I still don't. What the hell were you talking about?

Re: Buy E&Es now?
I am trying to say that even though we are talking with big and important 1L-3Ls, their experience may not necessarily make their advise more valuable on matters that are essentialy common sense. For example, "you need to emphasize what your professor teaches and wants you to know" - it is freaking common sense applicable to any education from K-12 to PhD. I am not even sure there are any professors in the world that would not fit this proposition.
However, when I make a statement of that sort somehow I am totally out of my league in understanding what really is going on in law school and should defer to 1L-3Ls...An idiot can figure it out , no rocket science degree required. Silly.

The difference is that in most other disciplines there is an objective body of knowledge that you are required to learn and that professorial noise is minimized. Law, on the other hand, is just fucked up. There are tons of factions and you reading a supp from an author who belongs to one faction will do almost nothing for you if your prof subscribes to the beliefs of another faction (which, again, you won't know until you begin law school). You can do profiling (and I actually recommend it -- although it will bring your study hours up), but doing it now during the summer is a ridiculous expenditure of time and energy because you are adding the variable of memory, and you want to reduce variables not add them.

Unless the author of the supp fairly presents both sides. Dressler gives his opinions often but he will also always present the other side. The goal for me, and I'm only reading on the train, isn't to learn black letter law, it is to understand the policy analysis and legal reasoning done by judges.solidsnake wrote:The difference is that in most other disciplines there is an objective body of knowledge that you are required to learn and that professorial noise is minimized. Dressler doesn't simply state for example whether or not he thinks it is constiutional to allow the death penalty for offenses other than intentional murder. He states both sides and discusses how the justices view the proportionality requirement of the 8th amendment. I am not going to enter the year with a set of legal rules that will conflict with my professors, I will be entering with a background in legal thinking.
Will it help me, probably not much, but it certainly won't hurt me. It would be a waste of time to read all summer long but reading two hours a day on the train is a good use of time if I find it interesting. The topics that are hard/boring/confusing I can always skip.

True all of that, except that I am not just reading on the train. I would rather read Dressler than read fiction or put together witty words on a funny picture or watch Tv === total freak.acdisagod wrote:Unless the author of the supp fairly presents both sides. lol@ thinking "presenting both sides" (filtered through the value systems of the author) = objective.acdisagod wrote:Unless the author of the supp fairly presents both sides. Reading some prof's hornbook is not going to give you a background in legal thinking, if you don't know how to read between the lines and see what (sometimes logically inconsistent) philosophies that prof is advocating.
Whatever. Do what you want, n00b.

Ask 30 people and you will get 30 diff answers.
For me:
Torts E/E - Horrid, I have a strong torts background and this book was horrible; the understanding book was much better
http://www.lexisnexis.com/store/catalog ... odId=13132
Crim E/E - would take a pass on this one too - The understanding book here is ok
K's and Prop - e/e are ok for these

Re: Buy E&Es now?
My 2 cents:
I bought all the E&E's before 1L year because I had a good income and didn't want to have to buy them during the semester. I opened two of them once, and donated all of them, in essentially perfect condition, to public interest association for their book sale. I found that I really didn't like the E&E format, and when I used supplements, I preferred a book like supplement like the Understanding series. So, I say, wait until the semester starts, go to the bookstore and read through some of the supplements, and give it 4-5 weeks to see if you really need a supplement in any of your classes.

Yes, every professor will have a different teaching method. E&Es will not work in each case.username1 wrote:Ask 30 people and you will get 30 diff answers.
