I think I did OK. I am absolutely sure I left points sitting out there, but I feel like I spotted and talked about a lot of issues. The only one I am really concerned about is the "appointing special counselors" part of the 1st question. I saw it as a Morrison analysis, but apparently no one else did.

I'm literally googling this case as we speak. I don't get it. Also, my teacher said something about we don't know if congress can impose a for-cause removal requirement on, for instance the Attorney General. My notes on the case are pretty thin, but I have that basically:
o Where Congress places restrictions on removal but does not take power for itself, there is no violation of separation of powers
o Where there is no aggrandizement of one branch by another or an invasion of the core powers then there is no separation of powers issue
o This does not involve Congress’ attempt to gain power in the removal of executive officials other than by established powers of impeachment and conviction
o Because Congress was not involved in the removal then Congress is not taking power to itself, violating separation of powers
Our hypo was Congress trying to squeeze out Presidential appointments to special posts by cutting funding to them. I argued that the power of the purse was within Congress' powers, but that the President has Executive appointment powers, and he'd probably win in a pissing contest with Congress over appointments, but not using funds that Congress marked for other things to pay for special appointments he wanted that Congress specifically cut out of a spending bill.
I am more than a little sure I completely fucked it up.

I guess I have 3-4 hours to learn it all tonight, and then a few hours tomorrow.
