Done with First Amendment. Big thanks to Holly, not sure I would have passed without her outlines. Further, holy crap that test sucked. Multiple choice questions like "What Justice did not say "x" in his concurrence in "y" case."

Plus 4 smaller "What are the relevant issues...discuss" questions. 4,000 words in just under 2.5 hours. My brain hurts.


And I get to do it all again in 5 hours for Crim Pro.

how is that even a law school exam? it sounds like a test you take in 4th grade where they test your ability to memorize everything and learn nothing

why on earth owuld any professor think that is information that you need to know to be a lawyer. wow.

Yeah, this is retarded. It's not like the practice of law is a memorization game where you don't have access to research materials. I never really understood closed-notes/book law exams.

My contracts exam last year was closed book. I think I like them better (when they're done correctly) because they force you to see things conceptually. That said, if law school was anything like being a lawyer, every class would be taught like LRW... which I think I would like.

Still not sure why law school isn't 1L as it is, 2L is all practical writing for the most part, and 3L is eliminated entirely.

I don't like closed book, because, for the most part, you still have to know everything. The greatest outline in the world won't help you spot issues you don't know or apply the law to the facts.

But in a class with a different test for each type of speech, that turns on subtle nuances in phrasings, it seems ridiculous to not allow at least one page of notes just so I can have the different tests for incitement versus obscenity versus commercial speech versus expressive conduct, etc.

Glad my outlines were helpful! I loved First Amendment, but part of it is definitely that I had an amazing prof and did NOT have your exam. haha

Now if only I could convince myself to get out of bed...

Step 1 - is it a government actor?

Step 2 - what value of speech is it? (Low - inciting words, fighting words, obscene, etc... / Intermediate - commercial speech, suppression of conduct with incidental impact on "expression" / High - political, artistic, offensive, indecent)

Step 3 -
If not high-value, check to see if it is a content/viewpoint based classification under RAV, if so, slap on strict-scrutiny.

If commercial speech, apply CENTRAL HUDSON intermediate scrutiny (substantial govt interest, substantially related means, directly advancing interest).

If "expressive conduct," make sure regulation isn't targeting the "idea" behind the content, if so, slap on appropriate scrutiny re: the level of speech being suppressed; if not, then apply O'BRIEN intermediate scrutiny.

If a "time, place, manner" restriction on high-value speech, use HEFFRON factors (significant govt interest, narrowly tailored but not least restrictive, and leaves open ample alternative channels).

Finally, if just basic low-level speech, just make sure the regulation isn't "over-broad" or "vague," then apply rational basis scrutiny.

I played the shit out of Skyrim when it first came out to try to get it out of my system in time for finals. Yesterday and today were the first days I didn't play it at all. But my first exam is tomorrow. I don't think my plan worked that well

First exam in 9 hours. I'm a little nervous, but I feel as ready as I'm ever going to be at this point. I did many a practice exam, and at least looked at model answers for the ones I couldn't get too. Somehow my professor has managed to be all over the board when it comes to questions he asks....can't wait to see ours. But most importantly, I can't wait to be done with this first one...it's always the worst one.

There's usually at least one "Law and XYZ" that could be slightly interesting, and the two that I've taken so far have been like half as hard as the standard doctrinal classes.
