I don't think RAP is bad, but to be fair, our professor kept it REALLY simple (mostly because she said she doesn't entirely understand how it works ).

Also, I imagine it could be harder with a closed book exam.

It's really not that complicated. It just has little twists that can trip you up, but if you understand the ultra-formalistic premise behind it, it's really not that difficult to grasp.

I think that 1367 and the preclusion doctrines were meticulously designed to be frustrating.

core concepts are really simple. applying them, not so much. especially when you throw in the 1441(c) dilemma. at least 40% of my civ pro studying has been devoted to understanding supp. jurisdiction and removal under 1441(c). makes erie look like paint by numbers.

like RAP in property, i plan on barely studying/understanding supp. jurisdiction and praying it isn't heavily tested on the exam.

We started to fall a little behind in civpro, so the last week and a half of classes are slated to be: Gibbs, Aldinger, Kroger, Finley, Exxon Mobil, Swift, Erie, Guaranty Trust, Byrd, Hanna, and Gasperini.

Gasperini was okay. Shady Grove was awful, incredibly long and my professor had strange views on what it meant.

My class didn't even do all of those and we did Erie at the beginning of the semester. Hanna v. Plumer basically saves lives and the E&E lays it out nicely if your prof doesn't.

i had only heard of erie before i actually took civ pro, and when we read it and covered it in class i was like, "pft, thats it? piece of cake!"

then we read york and i saw where it was going and i was like "... oh shit.."

My teacher literally had us do Erie, and that was it for the Erie doctrine.

Our professor told us to "skim" Erie and the related cases. He talked about Erie for a while then was going to move onto one of the other cases (Hanna, I think), and said, "Nevermind, I don't care. None of this is going to be on the exam anyway."

Anyway... i wasted my day. I finished a short section of con law, and might finish trademark (the shortest section of my IP survey tonight.) Original goal: have Con Law, Civ Pro and IP done by tonight. Wap wap.

Yeah. My school lets you pick an elective your first year. So, it's nice to take a class I'm actually interested in.
