I'm pretty sure Twombley/Iqbal shift away from notice pleading is the only really big new thing to worry about, take note and move onWhatisthis wrote:seespotrun wrote:This is the only credited response.booyakasha wrote:Get Glannon.
I've actually found Glannon to be dated. Though, we've only really covered pleadings thus far, so maybe the rest of the book is fine, but I've found it kind of frustrating so far. Glannon refers to the Conley "no-set-of-facts" standard as well as an outdated rule 15 over and over.
Is there anything like Glannon, but more recent?

You may be too stupid for law school but if you are, its entirely independent of not getting civ-pro. Seriously, read Glannon's preface to Erie sometime, something along the lines of "if an angel had told me that I would one day teach students the Erie Doctrine, I would have become a florist"

Civ Pro is a funny subject... I always knew what was going on... and then out of nowhere, something would pop up that I didn't fully understand until I really worked at it for a bit... Also, there are some people running around here that know stuff.. Substantive questions about concepts don't violate your schools honor code; I'm sure (so long as it doesn't relate to a specific assignment).
And as an aside, I've met some brilliant lawyers, but I've also met some complete idiots. They all passed the bar.. So I Wouldn't worry too much about your level of intelligence.

Read the E&E. It's clear and awesome. Then get an outline from a 2L who did well. Then completely stop reading the casebook. Cases in civpro just seemed useless. You don't need 3 cases to illustrate what summary judgment is.
