Re: ITT: help OS pass property!
Lots of great legal theorizing going on here, but don't forget the underlying fact pattern! No discussion of the changing nature of landlord-tenant law is complete without a nod to the conditions when the law originated (ie, grants of land for agriculture under the feudal system) as compared to the modern context of landlord-tenant (ie, rent of living space in heavily urban settings). It can also serve as a great framing device for discussions of the various doctrinal shifts, if you haven't already got a framing device up your sleeve.

Antipodean! You are most welcome in my thread. Good to see you here, and this is an excellent point; policy questions are the perfect place to discuss the historical shift of landlord-tenant expectations regarding services in urban settings. I know we would be in serious trouble if [the management company] expected us to fix anything. Even when they aren't legally bound to do whatever it is we need help with, they always do.Antipodean wrote:Lots of great legal theorizing going on here, but don't forget the underlying fact pattern!
