Does your prof want you to use cases? I'm not planning on using any

MIne said he wanted cases so I used it throughout the test. It was pretty easy though I just used the first name of the case and what rue came out of it. However, just go with what your prof wants. If he doesn't care its only going to slow you down.

Alright on the eve of my torts exam, wanted to see if others were noticing the same thing... I dont use any cases (maybe a couple) when I am doing my torts practice tests. Is anyone else noticing the same thing?

Yeah, mine is a closed book exam, so that's how I've been practicing, which means the cases that I do site are usually just key cases like Rylands or even basics like Dougherty just because I happen to remember it for trespasses which don't cause damage by virtue of the trespass.

Did you get moore v regents in Torts? We had it as a property issue.

And ya I never use any cases on my practice tests except when I'm talking about something like "the morrison tort" or rylands-type liability. Otherwise I would only refer to cases by analogy.

The cases can sometimes be helpful in your analysis.

In criminal, for example, you could point to some of the cases in causation, to see how reasonably foreseeable something is, and how your fact pattern compares to the case you cite.

Yeah we had Moore as a case dealing with Informed Consent and elements surrounding it. My property class was useless. We covered maybe 120 pages over the semester.

Just got back from my first exam (contracts). Interesting, to say the least. 2.5 hours to do a hypo that was ~1.75 pages long (single spaced). Was a weird hypo (the offer/acceptance was REALLY weird), but I did my best. I was confused and nervous for the first 25-30 minutes, which sucked, since I ended up writing a bunch of random stuff all over the place, and skipping around from issue to issue. But after that I calmed myself down a lot and went at it logically. Finished writing about all the issues I initially spotted with like 30 minutes at the end, which let me find like 3 more to write about it. My paper maybe wasn't as fluid as it could have been, but this professor doesn't really seem to care about that. Ended up writing like 29,000 characters, which I guess is a good amount (didn't say how many words, but I guess around 5000-5500) considering how much I went back and deleted and rewrote stuff that I write in the beginning.
