So what do you guys say for breach?
A has a duty to act as a RP of OP towards C because C is in the row below him.
A breached his duty when he went to grab B and instead fell over and landed on C (should I insert injury caused)
Is this how you guys set up your breach analysis? For some reason I am finding it awkward to say what the breach is or to know what to put for the breach.

Duty: general standard duty of care and specific duty
Breach: ∆ breached his duty when ___________. (usually a one liner)
My Torts prof is freaking crazy. She said we are going to get a 9 page long, single-spaced (I swear it is 11 point font), fact pattern, and 15 multiple choice questions (only God knows what she is going to come up with), and a policy question. HOLY HELL.

Just out of curiosity I did a quick thing online to measure my typing speed (I don't wanna study any more for my final tomorrow and its obviously too early to go to bed, so I'm just trying to kill time for 3-4 hours until I can go to bed haha) and got 87 wpm. Surprised myself with that tbh, given that I type mostly with my index fingers.

Good PT. Typed lots of words. I stupidly left some easy points on the table though. Missed a statutory issue that was pretty simple, where the statute was designed to prevent a different kind of harm then the one inflicted so it's only evidence of a general negligence, not per se negligence resulting harm.
I even had it circled in the fact pattern.

I've done that a few times (only once with a 'major' issue, luckily...) on practice exams so far. Its the worst.thelong wrote:Good PT. Typed lots of words. Alright on the eve of my torts exam, wanted to see if others were noticing the same thing... I dont use any cases (maybe a couple) when I am doing my torts practice tests. Is anyone else noticing the same thing?
