LRW a total time sink for anyone else? LRW for us is 3 credits, graded and curved. All I want to do is outline for other classes but this memo is worth 50% of our grade

It was for me...when is it due?

Day before Thanksgiving. It will be nice that we will basically be done with that class once we hand that in, but I also need to finish my outlines

how far have you gotten into writing?

I have a good chunk of the research done, just need some more fact specific cases. I've got the questions presented done and am working on the statement of facts

I havent read through this whole thing. Besides the BLL for Torts and K whats the most important thing?

My torts outline is basically just BLL from all the cases
My K outline is rule based with implement of UCC, Restatement 2nd and CaseLaw.
Missing something?

What about crim? My prof focuses on diff between MPC and common law, so I think that is big

Can someone tell me how to express a duty for negligence?

Right now I have duty to act as a reasonable person would under the circumstances, but what about landowners, and professionals, etc. Is there only that one duty and then everything else follows? This is so frustrating.

Can someone tell me how to express a duty for negligence?

Right now I have duty to act as a reasonable person would under the circumstances, but what about landowners, and professionals, etc. Is there only that one duty and then everything else follows? This is so frustrating.

(1) Determine if the D owed P a duty - did D's affirmative act create risk? was the plaintiff's harm foreseeable? If D did not create the risk, does one of the no-duty-to act exceptions apply? (special relationship with victim/perpetrator, innocent creation of risk etc.) As a general rule, duty owed is to act as an ordinarily prudent person would under the circumstances. Thats really all you need to say under duty (judge determines the legal duty.
(2) Now you analyze if D breached duty - so apply the facts. If professional, duty owed is to act as a ordinarily prudent professional would under the circumstances (or child of like age, intelligence etc) - the duty owed is always in light of the circumstances. If a doctor negligently performed surgery, and is sued, the P will have to show what an ordinarily prudent doctor would have done under the circumstances (ie: an ordinary doctor in the community - actually transitioning toward a national standard - would have removed the metal instrument before sewing up the incision). Remember that the duty is not to act in a way that PREVENTS foreseeable harm. Danger consists in the risk of harm, as well as the likelihood of it – danger occurring does not need to be more probable than it not occurring but rather “if there is some probability of harm sufficiently serious that ordinary men would take precautions to avoid it, then failure to do so is negligence”
