I mean, you shouldn't have to actually use the outline. I'm curious, though, about how much people actually do end up using their outlines on exams. In the practice tests I've taken so far, I've looked through mine a lot (IMO, anyway; guess its hard to really say what 'a lot' is), mostly just because so far I don't have most of the law memorized (starting to get on that now, though). I guess once I do have most of the law memorized I won't need to bother looking through it...

On Torts PTs, do you have a lot of analysis under "cause in fact?" Or mostly proximate cause?

I think it's worth searching for a defendant's response to but-for causation and throw some back and forth.
"Plaintiff will say but for... blah blah blah . Defendant will say even if I hadn't done... blah blah blah... the accident still would have happened."
Also worth bringing up preponderance of evidence being the standard for the but-for causation.

Took my professor's 2009 K Midterm as a PT today...FML wow that sucked. I've done 3 torts exams so far that have been decent, and Civ Pro is going alright, but Crim and Ks? Holy shiiiit FML.

I asked the TA about it and he said "proximate cause is assumed on all your hypotheticals, so you won't have to analyze it."
I guess it's like saying "assume all contracts exist and are enforceable"

The defendant made a clearly proven but quite insignificant contribution to the result
Obviously if your professor taught is differently, do what your professor said. I got the impression mine doesn't really like substantial factor much.
