Also completely bombed con and likely won't be transferring. Damn teacher did not teach United Haulers/Davis v. Kentucky but based an entire fact pattern on it...

So? If you learned the cases before them, wasn't it testing your ability to reason and not your ability to copy / predict SCOTUS?

Lol. I think my ConLaw exam had to be the worst. We were given 50 short answer questions with random quotes from cases we read. We had to identify each quote by Justice, case, and whether it was from a dissent, concurring opinion, or majority opinion. We also had to identify whether a hypothetical quote (not from a case) is more developmentalist, doctrinalist, originalist, structuralist, contextualist, etc... For essay, we had to predict whether certain Justices would uphold a particular legal doctrine on appeal.

Your professor is also a dick. I mean, seriously, identifying passages from opinions???? That reminds me of senior year English (High School) where we had to memorize passages from Shakespeare. What good does that do at all? Yes, it forces you to read the opinions, but who gives a shit? I don't think I could take that. I would drop out or something.

I keep trying to remind myself that I was convinced that I was going to get all Cs during finals last semester. Hopefully feeling stupid before/during finals will turn out to be a good thing again. I can only hope.

That's what I'm hoping about the exam I took today. Everyone was weirded out by it and the character limit completely sucked. Nothing like having to erase great analysis b/c you still need at least 3,000 characters to talk about another guy's liability and then do so in a rushed and conclusory fashion. Ugh.

Is she anything like her husband? I actually really liked con law from him. At least you know the grades will get back pretty early since they are leaving for Burma in a few weeks.

I mean, depending on the con law issue, there really is no such thing as a wrong answer. I'd venture to guess that most con law exam questions are about areas of the law sufficiently unsettled that that would be a correct statement. When I took con law with Chemerinsky at Duke as an undergrad, the exam was something like, well if one day fetuses are viable from basically the moment of conception (you could take them out and foster them in a dish somehow), would that mean that abortion isn't constitutionally protected from the moment of conception? Or does viability mean viability by old-fashioned means, or would the test evolve, etc.? No wrong answer to that, clearly.

Our question was like this: Is the cannon of Constitutional avoidance more likely to be applied by a contextualist, originalist, textualist, structuralist, or developmentalist justice? In a well-developed essay, analyze the merits of this question, drawing on theory, journal articles, case law, and legal doctrine. Counts as 50% of your grade.
