It is most definitely not. Legal writing will never again be like LARW. For LARW, the stress is on the form (citations, argument structure, headings, ect.). In REAL legal writing, so long as the form is proficient at getting your point across no one cares about it. What everyone actually cares about then is the substance and creativity of the writing. Which is not at all what you are graded for in LARW. In fact, your professor flat out tells you what the substance of the writing needs to be. If you do actually try and be creative, the best you can expect is a pat on the head in the form of a comment. It won't help your grade.

I thought I was going to hate writing memos for work after going through legal writing. Turns out it is actually fun.
Could LARW be more comparable to academic legal writing than it is to the writing one would do in the actual practice of law?

I think I'm going to listen to what the professors say about the cases before I start briefing them. I just feel it'd be pointless to brief these first ones.

Leadmentor just sent out some of his briefs as an example. Not really the confidence booster or the workable example I had hoped for. v8 & bosque, willing to do the same for comparison purposes? jew27@duke.edu

I kind of did mine differently than most, sooo....PM me if you still want to take a look? I'm not sure that mine will be very helpful, but I'd be glad to send it to you.

I will say this: in my opinion, the point of briefing is to (1) have something to jog your memory about the case and (2) help yourself learn and retain the important parts of the case. Because of this, form itself isn't really as important as finding something that works for you.

This is from a review of a torts hornbook on Amazon; you can't make this stuff up:

This is biased, pro-plaintiff, and hard to follow. It is a self-justifying, defender of the out of control legal profession. Only 60 pages are devoted to the defense. There is nary a word, beyond brief dismissal, of the devastation wrought upon our besieged Nation by the profession. There is nary a word about changing the unconscionable 80% error rate in tort litigation. There is nary a word about the wackiness that passes for judicial decision making, mind reading, fortune telling, etc.
If you have poor vision, good luck. A very large fraction of the text, often the most important point, is in tiny font in the footnotes. Its physical content discriminates against anyone with poor vision or who is out their twenties. The language is filled with double negatives, inscrutable constructions, undefined latin phrases. Is English the native language of either the author or his editor? My 7th grade English teacher would have made the author stand in the corner.

Memo to the editor: ban footnotes containing more than a reference. Ban double negatives. Take an English as a second language course, for Pete's sake.

Nah, I don't finish until 4. I actually like my schedule. I've never had class at any level of schooling go by as fast as it did today. Maybe going to lawl school was the right decision after all...

Does anyone know if there's a working online student directory? I'm trying to contact the people in my LARW group and I don't know what to do save for sending emails to "firstname.lastname@duke.edu" and seeing if that works. When I tried accessing the directory (http://www.law.duke.edu/studir), I was kicked to a "Denied" screen.
