DOJ Background Check - Faster due to clerkship?

Post by Anonymous User » Mon Aug 09, 2021 12:50 am

Hi Ya'll. I clerked less than 2 years ago and had a TS/SCI clearance adjudicated by the DOJ based on some cases. After the clerkship, I took a private sector job and was told my TSC/SCI was deactivated. I'm now in the process of applying to the DOJ and was wondering if my background check process will take just as long as someone who never had a clearance or whether my prior clearance will allow me to start within a few months after accepting an offer.

Has anyone been in a similar position where they got their DOJ clearance processed quickly or were able to join the DOJ on a provisional basis while awaiting the updated results because their prior investigation was still valid? Just wondering how long it would take from Acceptance to Start Date. Thanks.

If it was two years ago, your TS/SCI should still be "current" (IIRC, the SSBI lasts five years).

If that's the case, they don't need to do a full SSBI - just update it. Process should be considerably faster, but as everything with the federal government and clearances, 1) your experience will vary and 2) it's going to take a while.

I don't know about a "few months", but the fact that you had a recent favorable adjudication will almost certainly make a difference.

It doesn't matter that the SSBI is current-- the break in service is the potential issue. If you are under two years, they should just do a review of an updated SF-86 and if there are no flags then no full re-investigation is needed. If it's more than two years, then a re-investigation is usually required, but SSOs (or whatever DOJ might call the person with responsibility for TS material/clearances) may have some flexibility in determining that.
