As the title states, I'm worried about being able to pass C&F due to a debt issue. Specially, there is a collection account on my credit report. The amount of the debt is ~5k for a credit card that is not mine. My brother stole my identity and I don't want to report it to the police. My brother has been in and out of jail for other unrelated crimes and I just can't bring myself to file a claim against him.
I know I could consult an attorney about this but I hoped someone might be knowledgeable about this and save me some $$$.

I think your options are to pay the debt or report him. Unfortunately.

if you don't want to report your brother, then as someone stated above, you will need to pay back the debt. call the collection agency and reach a settlement or set up a payment plan. you need to show that you're actively paying it off or have paid it off.Anonymous User wrote:As the title states, I'm worried about being able to pass C&F due to a debt issue. even if you do the pay the debt, you'll probably need to disclose the details of the debt to the bar anyway (honesty is key and all that). I actually have no idea how the bar would view you covering for your delinquent sibling, but I can't imagine it'd be favorable.

Look at the question for your state bar. I had a similar issue, but thankfully, the family member worked with me to get the debt paid before I submitted my C&F. California only asked if you have current uncollected debts, and I verified with the bar that I would not have to disclose if the debt was paid off.
