Conflicts Check for SA

Post by NotoriousBIGlawlz » Mon Mar 07, 2016 4:36 am

My firm wants me to submit every single client/matter I worked on at my previous 2 firms for the upcoming SA.

Firm #1:
- The firm before law school was a plaintiff's mill (Workers' Comp + P.I.). I worked on hundreds of matters and cases just as a legal assistant. I'm almost positive the lower income, underrepresented Hispanic clients I assisted with their suits against small business owners will not be adverse to my biglaw firm.

Firm #2:
I also worked in public interest (1L summer) where a substantial majority of my work was initial client interviews within the realm of landlord-tenant law and unlawful detainers (both completely irrelevant in the practice group I'm assigned to). I mostly did initial consultations and only 1 case I handled settled in court. When I asked management for clarification, they required EVERY single case/matter I worked on.

Problems:

For Firm #1, poor management policies and extremely high attribution rates meant that they likely transferred/deleted the internal records of all the cases/matters I was involved in. It's been almost three years since I left due to law school. And even if they could procure such a list, I am supposed to list the hundreds of Hispanic clients I assisted? And if they can't procure a list of my past work, what I am supposed to do in regards to the conflicts check?

For Firm #2, as mentioned above, most of my work was initial client with another underrepresented minority group. Am I supposed to find the names of all the individual prospective plaintiffs even though the dozens I assisted for didn't pursue further legal actions.

If I were to list all the parties involved and a brief summary of the matter, my list would go on for pages and pages (assuming I have access to my previous work).

Hey future SAs care to share what you're process has been? Thanks a bunch

Not a future SA but my conflicts check was just listing of cases where the firm was the opposing party. Eliminated all problems like this.

I paralegal'd in college and would have had to list 40+ matters so I flagged as much to the firm and got them to agree to let me type a couple line summary of the nature of my work (mostly title stuff) and then agree to immediately flag to them if I recognized any party names.

I have friends at other firms who did something similar and I have friends at other firms still who were not ok with that approach at all and made them list out everything they could remember or get a hold of.
