Types of Crimes - AUSA/AG/DA

Post by Anonymous User » Thu Sep 24, 2015 1:42 am

Hello:

What types of prosecuted by the US Attorney vs State Attorney General vs District Attorney?

I know what type of crimes are prosecuted by DA's, but am confused about what type of crimes are prosecuted by AUSA/State AG. I know AUSA is for violations of federal crimes, but what are they?

I heard AUSA's largely prosecute drug cases. I just wanted to see if the rumors were true.

AUSAs: lots of drug crimes - not simple possession, but PWID and conspiracies. White collar - mortgage fraud, Ponzi schemes, Medicare fraud, etc. Public corruption like a bent federal agent. Threats against the president.

The biggest difference is that AUSAs do a lot less of what you typically learn about in Crim. Much less murder/assault/DV - almost no burglary/theft etc. The violent crime AUSAs do see is either by or against federal agents, on federal land (like a national park), or otherwise under federal jurisdiction, like on Indian country (that ends up being a lot in certain districts).

Otherwise there has to be some kind of federal nexus. Crimes involving stuff that crosses state lines or making use of interstate commerce or somehow using telephone lines/computer networks. Which reminds me that it includes child porn and gun crimes. (Also computer-based crimes - identity theft, various kinds of fraud, etc.) it will vary somewhat by location - if you're in a border district you'll do criminal immigration. If you don't have any Indian country in your district you will have less violent crime. Etc.

Thank you. For the two posts above, it did not answer what type of crimes AUSAs prosecute.

I was curious if I should work at the AUSAs. It seems as if DA's do more interesting work.

In CA, the AGs office deals with the appeals of all criminal cases and the trials when the DAs office has a conflict. Most of the cases deal with sufficiency of the evidence or problems with sentencing. Lots of reading and writing. Very chill with flexible hours. You get to go to court about once or twice per month. Pay isn't great though.

Depends on what you think is interesting. Some people find drug crimes (investigations, working with cooperators, doing wiretaps, arranging controlled buys, etc.) fascinating. Some people don't. Some people find white collar crime (heavily document intensive, lots of negotiating if you're dealing with large corporate defendants, takes a long time to go to trial, long trials, sophisticated people doing skeezy things) fascinating. Some people don't. Some people find child porn/sex crimes/internet crime fascinating. Some people don't. As mentioned, DAs do more of the traditional violent crimes, and some people find violent crimes fascinating, but others just find them difficult and depressing as all hell (lots of people with substance abuse problems, victims who don't always trust law enforcement/don't always come across much better than the perpetrators).

Thanks everybody!

No matter what I want to be a DA. But I also may want to be an AUSA later on in my career (deciding if I should extern there). I love doing trials, and I do not like as much researching and writing. I like to do violent crimes (murders, etc.). But I also want to take down organized crime and gang leaders. However, the DA Office I ultimately want to work for does organized crime. I am not sure if they target gang leaders, etc. What do you all think? Do I need to extern at the AUSA's to be hired there later on?
