The patents supporting the judgment are pretty likely invalid post-Alice. This type of case illustrates why patent lit is likely to cool off.

CBM was denied by the PTAB, so this troll flash LLC at least had some merit in its patent

Alice will only increase litigation because people will think they can beat the patent and the only way to do it is fight it out. After a while, Trolls will just move onto hardware stuff.

The only thing that worries me is fee shifting.

CS,EE, not so much for pharma, bio. Troll is the reason firm like mckool smith can pay way above NY scale in recent years. In this case Flash llc is represented by former McKool partners.

Pharma is probably okay either way, but bio would probably get besieged by packs of CS doods willing to undercut u on price.

What I don't get is why CS/EE tech companies are still going bonkers with amassing huge patent portfolios that are going to be worth less than shit in the future.

1) It's a good defense against competitor suits.

2) Even a really broad interpretation of Alice and a broad patent reform bill won't make legit tech patents worthless.
