That's dumb, but I've seen way worse. I worked on a matter where they* accidentally put a change of control clause in a low-level employee's employment contract. Guess how that turned out for the company (which was ultimately sold, but included an indemnity clause in the sale agreement), the company that purchased the company, and the employee who was like "wait, you mean this contract says I get a bunch of money because some conglomerate in Detroit owns this company now instead of some conglomerate in Jersey? Fucking score!"

I mean if you let your sandwich guy go next door and become a sandwich artist, next thing you know Subway is offering free smells and you're out on the street. Gotta guard that proprietary knowledge.

I've been to subway, and there's no fucking chance they stole that "talent" from anywhere that actually makes sandwiches.

You can write whatever you want, but I don't think it would be enforceable, depending on state law, for the average cat making sandwiches at Jimmy Johns or Subway.

Probably not enforceable, but when you're dealing with $8 an hour sandwich makers, it's not like they can afford to hire a lawyer and put up a defense. Until they serve one of the billion unemployed law school grads, who just happened to wind up working at JJ.
