Fed Gov Background Check Question

Post by Anonymous User » Mon Sep 29, 2014 11:40 pm

I am accepting an offer with the federal government, and they let me know it requires a background check.

While my police record is clean (not even a single traffic citation) I did receive one written warning in college from the disciplinary board for something minor (possession of stolen college property-- I didn't even steal it, it was just in my room at the time). This never went to the police or anything, just a written warning from the university (no probation or anything either, I know people who got worse for underage drinking).

Now obviously I'll have to disclose this for C&F when applying for the bar (which I don't imagine will be a problem), but I'm trying to figure out if and where I should disclose this during a federal background check. There is a section on the form for police records, but that doesn't seem to be the right place for a college disciplinary record warning. Under the education section there is no question like there was on law school apps asking if you've ever been disciplined by the university.

Since they don't ask for school disciplinary records, should I just not put this anywhere? Just want to make sure I'm doing everything by the book.

I would err on the side of caution. Candor is always appreciated and you do not want to lose your chance at the gig late because you failed to disclose.

If it is truly not asked for, then perhaps you need not disclose though...

Is there a general question asking if there is anything in the past X amount of years that would call into question your C & F?

Frankly I think it's too minor to include, and you're right that there isn't anywhere to put it. Here are the offenses that they're looking for on an SF-86:
Complete the following if you responded 'Yes' to one of the following:
- In the past seven (7) years have you been issued a summons, citation, or ticket to appear in court in a criminal proceeding against you?
(Do not check if all the citations involved traffic infractions where the fine was less than $300 and did not include alcohol or drugs)
- In the past seven (7) years have you been arrested by any police officer, sheriff, marshal or any other type of law enforcement official?
- In the past seven (7) years have you been charged, convicted, or sentenced of a crime in any court? (Include all qualifying charges, convictions
or sentences in any Federal, state, local, military, or non-U.S. court, even if previously listed on this form). - In the past seven (7) years have you been or are you currently on probation or parole?
- Are you currently on trial or awaiting a trial on criminal charges?
You don't meet any of these, so just answer no and move on.

Oh, and this is obviously not legal advice. Consult a real attorney blah blah blah.
